메타버스 등 가상세계 성범죄의 법적 대응방안 연구

본 연구는 4차 산업혁명 시대 급속히 확산되고 있는 메타버스에서 발생하는 성범죄의 현황을 분석하고 법적 대응방안을 모색한다. 메타버스의 개념과 기술적 특징을 먼저 검토한 후, 국내외 메타버스 성범죄 사례를 분석하여 현행법상 처벌의 문제점과 한계를 도출한다. 특히 아바타에 대한 성폭력, 온라인 그루밍 범죄 등 비접촉 행위의 처벌 근거 부재, 아동·청소년의 취약한 보호 구조, 플랫폼 운영자의 책임 불명확성 등을 주요 문제로 지적한다. 이에 대한 해결방안으로 성폭력처벌법 및 정보통신망법 개정을 통한 처벌 규정 신설, 성적 인격권 침해 범죄의 신설, 성폭력범죄의 개념 재정의, 플랫폼 운영자의 법적 의무 강화, 민관 협력체계 구축 등 다층적 입법 전략을 제시한다.

This study analyzes the current status of sexual crimes occurring in metaverse, which is rapidly spreading in the era of the Fourth Industrial Revolution, and seeks legal countermeasures. After examining the concept and technical characteristics of metaverse, it analyzes domestic and foreign cases of metaverse sexual crimes to identify problems and limitations in current law enforcement. In particular, it points out the lack of punishment grounds for non-contact acts such as sexual violence against avatars and online grooming crimes, vulnerable protection structures for children and adolescents, and unclear responsibilities of platform operators. As solutions, the study presents multi-layered legislative strategies including enactment of punishment provisions through amendments to the Sexual Violence Punishment Act and Information and Communications Network Act, establishment of sexual personality rights violation crimes, redefinition of sexual violence crimes, strengthening legal obligations of platform operators, and establishment of public-private cooperation systems.
