저작권의 철학적 정당화 기초: 자연권론과 인격권 이론의 비교 분석

본 연구는 저작권의 정당화 근거가 되는 두 가지 주요 철학적 이론인 자연권론과 인격권 이론을 비교 분석한다. 자연권론은 존 로크의 노동이론에 기초하여 창작자의 정신적 노동이 창작물에 대한 배타적 소유권을 자연법적으로 정당화한다고 본다. 반면 인격권 이론은 헤겔의 법철학에 근거하여 창작물이 창작자의 인격을 반영하는 정신적 산물이므로 창작자의 인격권과 불가분적으로 결합되어 있다고 주장한다. 본 논문은 이 두 이론의 사상적 기초, 법적 적용, 그리고 역사적 발전 과정을 체계적으로 분석함으로써 현대 저작권 제도의 철학적 기초를 규명한다.

This study conducts a comparative analysis of two major philosophical theories that serve as justifications for copyright: natural rights theory and personality rights theory. Natural rights theory, based on John Locke's labor theory, argues that the creator's mental labor naturally justifies exclusive ownership rights over the created work. Conversely, personality rights theory, grounded in Hegel's philosophy of law, contends that creative works are spiritual products reflecting the creator's personality and are thus inseparably linked to the creator's personality rights. By systematically analyzing the philosophical foundations, legal applications, and historical development of these two theories, this paper elucidates the philosophical basis of the modern copyright system.
