플랫폼 노동 확산과 근로기준법 적용 한계에 따른 노동법 패러다임 재편

본 연구는 디지털 플랫폼을 기반으로 한 노동의 확산이 기존 노동법 체계에 미치는 영향을 체계적으로 분석한다. 플랫폼 노동자의 법적 지위 불명확성, 근로기준법 적용 범위의 한계, 플랫폼 기업의 사용자성 판단 기준 부재 등을 핵심 쟁점으로 식별하고, 이러한 문제들이 기존 노동법이 전제하는 이분법적 고용관계 모델의 한계에서 비롯됨을 논증한다. 알고리즘 기반 노동 통제, 경제적 종속성, 형식과 실질의 괴리 등을 분석하여 근로자성 판단 기준의 재정립 필요성을 제시한다. 또한 EU의 근로자 추정제, 영국의 중간 법적 지위 도입, 미국의 주별 입법 실험 등 해외 사례를 비교 분석하여 한국 노동법 개선의 시사점을 도출한다. 결론적으로 근로자 개념의 확장, 플랫폼 기업의 책임 범위 명확화, 사회보장제도 확대, 알고리즘 규제 체계 구축 등을 통한 노동법의 근본적 재편을 제안한다.

This study systematically analyzes the impact of platform labor expansion on the existing labor law system. It identifies key issues including the unclear legal status of platform workers, limitations in the application of the Labor Standards Act, and the absence of clear criteria for determining the employer status of platform companies. The research demonstrates that these problems stem from the limitations of the dichotomous employment relationship model presupposed by existing labor law. By analyzing algorithm-based labor control, economic dependence, and discrepancies between form and substance, the study presents the necessity of reestablishing criteria for determining worker status. Furthermore, it conducts comparative analysis of overseas cases including the EU's worker presumption system, the UK's introduction of intermediate legal status, and US state-by-state legislative experiments to derive implications for improving Korean labor law. The study concludes by proposing fundamental restructuring of labor law through expansion of worker concepts, clarification of platform companies' responsibilities, expansion of social security systems, and establishment of algorithmic regulation frameworks.
